1. Acceptance of Terms
By accessing or using Kowbi ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Kowbi provides a booking management and self-service kiosk platform for photo studios, creative spaces, and similar rental businesses. The Service includes online booking, payment processing, check-in/check-out management, and related features.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use the Service
- One person or legal entity may not maintain more than one free account
4. Pricing and Payment
Free Plan
The Free plan has no monthly subscription fee. Kowbi charges an 8% transaction fee on each booking processed through the platform.
Paid Plans
Paid subscription plans are billed monthly or annually in advance. Prices are subject to change with 30 days notice. Paid plans have no transaction fees from Kowbi (standard Stripe processing fees still apply).
Payment Processing
All payments are processed through Stripe. By using the Service, you agree to Stripe's terms of service. You are responsible for any fees charged by Stripe.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Use the Service to send spam or unsolicited communications
- Resell or redistribute the Service without authorization
6. Studio Owner Responsibilities
As a studio owner using Kowbi, you are responsible for:
- Ensuring your studio complies with all applicable laws and regulations
- Maintaining appropriate insurance coverage for your business
- Honoring bookings made through the platform
- Handling client disputes and refunds appropriately
- Protecting client data collected through the kiosk
- Ensuring your pricing and availability information is accurate
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Kowbi and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOWBI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Termination
We may terminate or suspend your account at any time for any reason, including violation of these terms. You may cancel your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.
11. Refund Policy
Paid subscriptions may be refunded within 30 days of purchase if you are not satisfied with the Service. Transaction fees on the Free plan are non-refundable. Refunds for individual bookings are handled between studio owners and their clients.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new terms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
